Welcome to cineario.ca (the "Website"), operated by CINEARIO ("CINEARIO," "we," "us," or "our"), a video production studio founded by Ario Rostamian and based in Ontario, Canada.
By accessing or using this Website, you ("you," "your," or "User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Website or any of our services.
These Terms constitute a legally binding agreement between you and CINEARIO. Your continued use of the Website following the posting of any changes to these Terms constitutes acceptance of those changes.
2. Description of Services
CINEARIO is a professional video production studio offering a range of creative and technical services, including but not limited to:
- Video Production — Full-service video production for commercials, corporate content, brand films, documentaries, and event coverage.
- Cinematography — Professional camera operation, lighting design, and visual storytelling for a wide variety of formats and industries.
- Post-Production — Editing, colour grading, sound design, motion graphics, and visual effects to bring projects to completion.
- Social Media Content — Short-form video production optimized for digital platforms, including vertical reels and promotional clips.
- Creative Direction & Strategy — Concept development, pre-production planning, storyboarding, and creative consulting.
The specific scope, deliverables, timelines, and fees for any project are defined in individual contracts, proposals, or statements of work entered into between CINEARIO and the client. These Terms govern your use of the Website and supplement, but do not replace, the terms of any such project agreement.
3. Intellectual Property & Copyright
3.1 Website Content
All content on this Website — including but not limited to text, graphics, photographs, video, audio, animations, logos, trademarks, and the overall design and layout — is the property of CINEARIO or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from this Website without the prior written consent of CINEARIO, except as permitted by applicable law.
3.2 Client Work & Project Ownership
Ownership of video content, raw footage, and other deliverables produced for clients is determined by the individual contract or agreement executed between CINEARIO and the client for each project. Unless otherwise specified in a signed agreement:
- CINEARIO retains ownership of all raw footage, project files, and working materials.
- The client receives a licence to use the final deliverables as specified in the project agreement.
- CINEARIO reserves the right to use completed work in its portfolio, showreel, and promotional materials unless a non-disclosure or confidentiality agreement has been signed.
3.3 Third-Party Content
Certain content displayed on the Website may include materials belonging to third parties, including client logos and project footage used with permission. All such content remains the property of its respective owners.
4. User Conduct
When using this Website, you agree not to:
- Use the Website for any unlawful purpose or in violation of any applicable local, provincial, national, or international law or regulation.
- Attempt to gain unauthorized access to any portion of the Website, its servers, or any systems or networks connected to the Website.
- Interfere with or disrupt the operation of the Website or the servers or networks used to make the Website available, including by transmitting any malware, worms, viruses, or other harmful code.

5. Booking & Payments
5.1 Booking Process
CINEARIO uses Zoho Bookings to facilitate scheduling of consultations and project discussions. By booking a session through our scheduling system, you agree to provide accurate contact information and to attend the scheduled appointment or provide reasonable notice of cancellation.
5.2 Project Fees & Payment Terms
All project fees, payment schedules, deposits, and payment methods are outlined in individual project proposals or contracts. General payment terms include:
- A deposit may be required before production begins, as specified in the project agreement.
- Final payment is due upon delivery of the agreed-upon deliverables, unless otherwise stated.
- Late payments may be subject to additional fees or interest as outlined in the project agreement.
- CINEARIO reserves the right to suspend or terminate work on a project if payment obligations are not met.
5.3 Cancellation & Rescheduling
Cancellation and rescheduling policies for booked consultations and production dates are outlined in the applicable project agreement. If no specific terms exist, we ask that you provide at least 48 hours' notice for any cancellation or rescheduling request. Deposits may be non-refundable depending on the circumstances and the terms of the project agreement.
6. Limitation of Liability
To the fullest extent permitted by applicable law, CINEARIO, its founder, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:
- Your access to, use of, or inability to access or use the Website.
- Any conduct or content of any third party on the Website.
- Any content obtained from the Website.
- Unauthorized access, use, or alteration of your transmissions or content.
The Website and all content therein are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall CINEARIO's total liability to you for all claims arising out of or relating to the use of the Website exceed the amount you have paid to CINEARIO, if any, during the twelve (12) months preceding the claim.
7. Indemnification
You agree to defend, indemnify, and hold harmless CINEARIO, its founder, employees, contractors, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to legal fees) arising from:
- Your use of and access to the Website.
- Your violation of any provision of these Terms.
- Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
- Any claim that your use of the Website caused damage to a third party.
This indemnification obligation shall survive the termination of these Terms and your use of the Website.
8. Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the Province of Ontario, Canada, and you hereby consent to the personal jurisdiction and venue of such courts.
9. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
10. Changes to Terms
CINEARIO reserves the right to modify, amend, or replace these Terms at any time and at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. It is your responsibility to review these Terms periodically for any changes.
Your continued use of the Website after the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the revised Terms, you must stop using the Website.
